This document is a proposed draft, not an effective agreement or a statement of verified practices. It does not replace Darwin’s existing Terms, Privacy Policy, or a signed agreement. Legal and operational review is required before publication as an effective policy.
This proposed Acceptable Use Policy sets out expectations for people, businesses, developers, and agents using Darwin, operated by Darwin Technologies, Inc. It is intended for legal review alongside the Terms and conditions. Existing contractual restrictions remain in effect; the proposed additions below are not yet adopted.
1. Act within your authority
Use only accounts, identities, data, and resources you are authorized to control. Do not impersonate another person or business, misrepresent your relationship to them, or instruct an agent to act outside the permissions granted by its principal.
Keep account credentials secure. Do not evade approval requirements, agreed spending limits, access controls, or a person’s decision to decline or stop an interaction.
2. Comply with law and respect people
Do not use the services to arrange unlawful transactions, facilitate exploitation or abuse, threaten or harass people, or infringe their privacy and intellectual property rights. Obtain the rights and permissions needed for content, personal data, likenesses, and materials submitted or used in a goal.
Where an activity requires a license, professional qualification, disclosure, or other authorization, do not misrepresent your eligibility or use Darwin to bypass that requirement.
3. Keep offers, evidence, and transactions honest
- Do not submit false identities, capabilities, availability, pricing, claims, or delivery evidence.
- Do not inflate impressions, clicks, engagement, reviews, or other performance measures artificially.
- Do not manipulate discovery, negotiations, pricing, or settlement through collusion or deceptive activity.
- Do not conceal material commercial terms or claim approval that a counterparty has not given.
- Do not use the services for payment fraud or to evade lawful restrictions on transactions.
4. Protect the network
Do not distribute malicious code, disrupt availability, probe systems without authorization, defeat rate limits, or access non-public data. Do not use stolen credentials or exploit another user’s account, integrations, or agent permissions.
Use documented developer interfaces within their permitted scope. Do not treat an authorized integration as permission to scrape unrelated data, extract confidential information, or bypass service restrictions. Report suspected vulnerabilities privately instead of exposing other users or their data.
5. Respect data and confidentiality
Use personal and confidential information only for authorized purposes. Do not expose another party’s private information or use access granted for one engagement to obtain unrelated data. Honor applicable retention, deletion, and confidentiality requirements in the governing agreement.

6. Reports and enforcement
Report suspected abuse to legal@darwin.so with enough information to identify the relevant activity, without sending unnecessary sensitive data. Darwin may investigate and take measures permitted by its effective agreements and applicable law. This draft does not create new suspension powers, forfeiture rights, or payment obligations.
The final policy should document how affected users can request review and how urgent security or legal issues are handled. Any adoption or material change must follow the applicable notice requirements.
